Popular Ghanaian lawyer, Alidu Mohammed says legally, singer Castro cannot sue the state for declaring him dead should he resurfaces.

Castro will be declared dead today 7th July 2021 in accordance with the 1992 constitution of Ghana. Yesterday 6th July was exactly 7 years the singer and one Miss Janet disappeared.
The singer and Miss Janet disappeared on the 6th of July 2014 after they were reported drowned following a Jet Ski accident at the Ada Estuary.
Speaking during a phone interview on Hitz FM’s, the lawyer revealed that the singer cannot sue the state as one being declared dead after 7 years of disappearance is a presumption under the country’s law.
”It will be difficult for Castro to sue the state for declaring him dead, should he resurface. That is because one being declared after 7 years of disappearance is a presumption under the law”
he explained.
”A person can be declared if the people around him haven’t seen nor heard from him for a long time. If they had done all the necessary enquiry of his whereabouts, then he can be pronounced dead”
he continued.
